UK Independent Mechanism: Updated submission to CRPD ahead of UK's UNCRPD examination

This submission has been produced by the United Kingdom Independent Mechanism (UKIM) in advance of the public examination of the UK’s implementation of the UN CRPD. In 2009 the UK Government designated the Equality and Human Rights Commission (EHRC), the Equality Commission for Northern Ireland (ECNI), the Northern Ireland Human Rights Commission (NIHRC) and the Scottish Human Rights Commission (SHRC) as the UK’s Independent Mechanism under CRPD Article 33, tasked with promoting, protecting and monitoring implementation of the CRPD.

Disability Rights in Northern Ireland UKIM Supplementary Submission

This submission has been drafted jointly by the Equality Commission for NI and the NI Human Rights Commission in furtherance of their role as the “Independent Mechanism” in Northern Ireland (NI) to promote, protect and monitor the implementation of the United Nations Convention on the Rights of Persons with Disabilities (UNCRPD).

In addition to the document, the video below was produced by the United Kingdom Independent Mechanism (UKIM) and contains a sign language version of UKIM’s main submission to the UNCRPD. In 2009 the UK Government designated the Equality and Human Rights Commission (EHRC), the Equality Commission for Northern Ireland (ECNI), the Northern Ireland Human Rights Commission (NIHRC) and the Scottish Human Rights Commission (SHRC) as the UK’s Independent Mechanism under CRPD Article 33, tasked with promoting, protecting and monitoring implementation of the CRPD.

Since the UK ratified the CRPD in 2009, UKIM has taken active steps to involve disabled people and their representative organisations as part of fulfilling its monitoring role and encouraged their full participation in the monitoring process. The individual independent mechanisms have used a range of activities to involve disabled people across the UK. For example, we have produced guidance and other resources and held engagement and capacity-building events, roundtable discussions and web-based seminars to ask disabled people to identify their priority issues. We have also provided financial support to disabled people’s organisations to allow them to participate directly in the CRPD reporting process.

Traveller Accomodation Investigation

Having undertaken a scoping exercise in June 2016, drawing on a body of research and mapping of policy and legislation, the Northern Ireland Human Rights Commission (the Commission) has decided to conduct an investigation into Travellers accommodation in Northern Ireland (the Investigation). Draft Strategic Plan 2016-2019

The Northern Ireland Human Rights Commission has been developing its Strategic Plan for 2016-2019. Thank you to everyone who has provided their views so far and contributed to the process. We have produced a first draft of our proposed new plan and want to hear from you on any further points you would wish to make before we finalise our strategic plan for the next 3 years.

We have identified 3 priority work themes over the next three years which are explained in full in the draft plan.

• Delivering Human Rights through Excellent Services to the Public

• Human Rights and Building the Future in Northern Ireland

• Social Economic Rights in a Time of Change

Alternative Care and Children

This report covers the rights of the most vulnerable children in Northern Ireland who cannot be cared for within their own family. The purpose of the report is to review the current provision and circumstances facing such children and young people and how international human rights standards can offer protection and support.

The report’s recommendations are also broad in scope and the Commission recognises that many organisations will want to build on this work and ensure that human rights are at the heart of any proposed reforms.

NIHRC Report to UNCRC Committee

The Human Rights Commission has published its report to the United Nations Committee on the Rights of the Child. It submitted its report to the Committee in July 2015. The performance of the United Kingdom will be considered by the Committee at a pre-session working group in October 2015. The Committee’s examination of the UK will take place at the United Nations offices in Geneva in June 2016.

The Commission has identified over 30 areas in Northern Ireland which require attention. It has advised that the UN Committee should ask the UK Government, including the Northern Ireland Executive to:

  • Take immediate action to increase the minimum age of criminal responsibility from 10 to at least 12 years of age.
  • Condemn the ongoing attacks by paramilitary organisations and ask the UK Government and the N.I Executive to take immediate and effective action to address the issue of paramilitary attacks against children.
  • Ban smacking of children without delay.
  • End Academic Selection-The UN Committee called for academic selection to be abolished in 2008 and despite the end of the 11+, the current system of testing has allowed a ‘two-tier culture’ to remain.

The Public Services Ombudsperson Bill [NIA 47/11-16]

The Northern Ireland Commission pursuant to Section 69 (1) of the Northern Ireland Act 1998, reviews the adequacy and effectiveness of law and practice relating to the protection of Human Rights. In accordance with this function the following statutory advice is submitted in response to the Committee for Education’s consultation on the proposed Special Educational Needs and Disability Bill.

The Commission welcomes a number of provisions in the bill that seek to improve access to individualised support for children with special educational needs or disabilities while also highlighting the role that secondary legislation will play in determining the nature of that support. The Commission notes the positive intention to provide better access to appeal rights for children and to ensure that they can express their views.

Human Rights Inquiry: Emergency Healthcare

This is the first national human right inquiry into health care in emergency departments undertaken anywhere in the world. The Inquiry builds on an international model of human rights inquiries to ensure the process was rigorous. The choice of an Inquiry into health care in emergency departments reflected the focus on the issue both politically and publicly. With around 700,000 visits to emergency departments in hospitals in Northern Ireland it is an issue which touches almost everyone’s life here.
